Please read these Terms of Service ("Terms") carefully before using the Thoughtogram website and service (the "Service") operated by James Barton ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Thoughtogram is sold as a one-time purchase. There is no subscription, no recurring charge and no automatic renewal. Payment is taken once, through our payment processor Stripe. All payment information is provided directly to Stripe and we do not store your payment card details. Prices are shown in US dollars (USD) unless stated otherwise.
Your purchase grants you a personal, non-transferable licence to use Thoughtogram for as long as the Service continues to operate, with unlimited boards and access to all features included in the Service at that time. It does not grant ownership of the software itself.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers in the UK and EU normally have 14 days to cancel a purchase of digital content. Because Thoughtogram is supplied immediately after payment, you are asked at checkout to agree to immediate supply and to acknowledge that you lose this 14 day cancellation right once supply begins. If you do not wish to waive that right, do not tick that box and do not complete the purchase.
Separately from, and more generously than, the statutory right above, we offer a 30 day refund, no questions asked. If Thoughtogram is not right for you, email support@thoughtogram.com within 30 days of your purchase and we will refund you in full and send you an export of your boards in Markdown format. Once a refund is issued, your access to the Service ends. Your boards are retained for a short period in case the refund was made in error, and are then deleted.
Thoughtogram is run by one person, and we want to be straightforward about what that means. If the Service is ever discontinued, we commit to giving you at least 90 days' notice by email before it is switched off, and to keeping the export function available throughout that period so you can take a full copy of your boards in Markdown format. No refund is due for a purchase made more than 30 days before such a notice, but you will never lose access without warning or without the ability to retrieve your own content.
An account is created for you when you purchase Thoughtogram, using the email address supplied at checkout. You must provide information that is accurate, complete and current. Failure to do so constitutes a breach of these Terms and may result in termination of your account. You must be at least 16 years of age to create an account and use the Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Our Service allows you to create and store information on your boards ("User Content"). You are responsible for the User Content that you post to the Service, including its legality, reliability, and appropriateness.
By posting User Content on the Service, you grant us the right and license to host, display, and distribute such User Content on and through the Service solely for the purpose of operating and providing the Service to you. You retain any and all of your rights to any User Content you submit and you are responsible for protecting those rights.
Your boards are private to your account. Card contents are encrypted at rest on our servers and are transmitted over an encrypted connection. We do not read your User Content, we do not use it to train artificial intelligence systems, and we do not share it with third parties. You can export all of your User Content in Markdown format at any time from within the Service.
You represent and warrant that: (i) the User Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.
You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. You agree not to post or transmit any User Content that is defamatory, obscene, pornographic, abusive, or that infringes any copyright or other right of any person.
We want you to get the most out of Thoughtogram and we do not impose hard limits on the number of boards or cards you create. We simply ask that you use the Service in good faith. In the rare event that an account's usage is so extreme that it compromises the stability and performance of the Service for other users, we reserve the right to reach out to discuss the situation and find a reasonable solution.
We may terminate or suspend your account if you breach these Terms or the Fair Use Policy. Except where a breach is serious or unlawful, we will contact you first and give you a reasonable opportunity to put it right. If we terminate your account for a reason that is not your fault, we will refund your purchase.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by using the account deletion feature in your account settings. Please note that account deletion is permanent and all of your User Content will be irreversibly deleted.
In no event shall James Barton be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted or error free.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under English law. If you are a consumer, you have legal rights under the Consumer Rights Act 2015 which require digital content to be of satisfactory quality, fit for purpose and as described. Nothing in these Terms affects those rights.
You are responsible for keeping your own copies of anything important to you. The export function is provided for this purpose.
These Terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere in the UK or in the EU, you keep the benefit of any mandatory consumer protection provisions of the law of the country in which you live.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
